1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Lookyhear website, products and services.

By accessing our website, creating an account or purchasing any product, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or purchase our products.

2. About Lookyhear

Lookyhear creates and distributes digital creative assets, including but not limited to sample packs, sound effects, field recordings, loops, one-shots, presets, photographs, textures, graphics and other downloadable digital content.

All products are supplied electronically unless otherwise stated.

3. Eligibility

By using this website you confirm that:

  • You are at least 18 years of age, or have permission from a parent or legal guardian.

  • You have the legal capacity to enter into a binding agreement.

  • Any information you provide is accurate and complete.

4. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login details.

You agree to notify Lookyhear immediately if you believe your account has been accessed without your authorisation.

You are responsible for all activity occurring under your account.

5. Orders and Payment

All prices are listed in Australian Dollars (AUD) unless otherwise stated.

Payment must be received before digital products are made available for download.

Lookyhear reserves the right to refuse, cancel or limit any order where fraud, misuse or unauthorised activity is suspected.

6. Digital Delivery

Products purchased through Lookyhear are delivered electronically.

It is your responsibility to:

  • provide a valid email address;

  • ensure your device and software are compatible with the purchased files;

  • download and securely store your purchases.

Lookyhear is not responsible for loss of files after delivery, although we may assist where reasonably possible.

7. Licence to Use Our Products

Unless otherwise stated, all purchases include a non-exclusive, non-transferable licence to use the purchased content.

You may:

  • use purchased assets in personal and commercial creative projects;

  • use assets in music releases;

  • use assets in podcasts, videos, films, television, advertisements and games;

  • use photographs, graphics and visual assets within original creative works;

  • monetise projects that incorporate Lookyhear assets.

You may not:

  • resell, redistribute or share the original files;

  • upload products to file-sharing websites;

  • include the original files within another sample pack, sound library or asset collection;

  • claim ownership of Lookyhear content;

  • sublicense, lease or transfer the files to another person or business;

  • use the assets to create a competing product where the purchased files form a substantial part of that product.

Ownership of all intellectual property remains with Lookyhear.

8. Intellectual Property

All website content, branding, logos, graphics, product names, product descriptions, photographs, videos, audio demonstrations and downloadable content remain the intellectual property of Lookyhear unless otherwise stated.

Nothing in these Terms transfers ownership of our intellectual property.

9. Prohibited Conduct

You agree not to:

  • interfere with website security;

  • attempt to gain unauthorised access to our systems;

  • reverse engineer, modify or circumvent security measures;

  • use automated systems to scrape website content;

  • engage in fraudulent purchasing activity;

  • use our products in a manner that infringes another person's rights or applicable law.

10. Refunds

Due to the nature of digital products, all sales are generally final.

Once a digital product has been downloaded or access has been provided, refunds or exchanges will not normally be offered for:

  • change of mind;

  • accidental purchases;

  • incorrect product selection;

  • lack of software compatibility where system requirements were available before purchase.

Nothing in this policy excludes or limits your rights under the Australian Consumer Law.

If a product is faulty, significantly different from its description, or cannot be supplied as advertised, you may be entitled to a remedy under Australian Consumer Law.

11. Technical Support

Lookyhear will make reasonable efforts to assist customers experiencing genuine issues accessing purchased products.

Support does not include:

  • training in third-party software;

  • installation of third-party applications;

  • compatibility issues caused by unsupported software or hardware;

  • custom editing or modification of purchased products.

12. Disclaimer

Lookyhear products are provided "as is".

While every effort is made to ensure quality and accuracy, we do not guarantee that:

  • products will meet every individual requirement;

  • products will be compatible with every software application;

  • the website will be uninterrupted or error-free.

Creative results will vary depending on the user's equipment, software and workflow.

13. Limitation of Liability

To the maximum extent permitted by Australian law, Lookyhear is not liable for any indirect, incidental, consequential or special damages arising from the use of our website or products.

Where liability cannot be excluded under Australian law, our liability is limited to the remedies available under the Australian Consumer Law.
